SafestWHOIS Service Agreement
(Any translation of this Agreement is done for local requirements and in the event of a dispute between the English and any non-English versions, the English version of these terms shall govern)
1.1 When the Registrant subscribes to the Registration Company's SafestWHOIS Service, the Registrant authorizes and directs the Registration Company to display an alternate contact information in the public WHOIS database for the Registrant, Administrative, Technical and Billing Contacts for the applicable domain name.
1.2 By subscribing to the SafestWHOIS Service, the Registrant authorizes and directs the Registration Company to process communications directed to the Registrant at the contact information displayed in the public WHOIS database as follows:
1. E-mail Address. An e-mail address provided by the Registration Company will be displayed in the public WHOIS database which will be changed from time to time at the discretion of the Registration Company. Messages received at the e-mail address posted in the public WHOIS database will be filtered for SPAM and forwarded to the e-mail address associated with the Registrant's account for the applicable domain name. Once an e-mail address is removed from the public WHOIS database it will no longer be a valid e-mail address for the receipt messages. The Registrant acknowledges that the Registrant may not receive messages sent to an expired e-mail address.
2. The Registrant acknowledges and agrees that by subscribing to the Registration Company's SafestWHOIS Service that the Registrant will not receive all communications sent to the Registrant at the contact information listed in the public WHOIS database. The Registrant acknowledges and agrees that the Registration Company disclaims any and all loss or liability that may result from the Registrant's use of the Registration Company's SafestWHOIS Service and/or your failure to receive important correspondence sent to the Registrant at the contact information displayed in the public WHOIS database, including, but not limited to, legal notices or UDRP complaints.
1.3 The Registrant acknowledges and agrees that the Registration Company has the absolute right and power, as it deems necessary with its sole discretion, without providing notice and without any liability to the Registrant whatsoever, to (a) reveal to third parties the contact information provided by the Registrant to the Registration Company in connection with the account for the applicable domain name, (b) populate the public WHOIS database with the registrant's name, primary postal address, e-mail address and/or telephone number as provided by the Registrant to the Registration Company, or (c) terminate the Registrant's subscription to our SafestWHOIS Service without refund:
1. if any third party claims that the domain name violates or infringes a third party's trademark, trade name or other legal rights, whether or not such claim is valid;
2. to comply with any applicable laws, government rules or requirements, ICANN policies or requirements, subpoenas, court orders, requests of law enforcement or government agencies; or
3. if any third party threatens legal action against the Registration Company that is related in any way, directly or indirectly, to the domain name, or claims that the Registrant is using the domain name registration in a manner that violates any law, rule or regulation, or is otherwise illegal or violating the legal rights of a third party.
1.4 The subscription of the SafestWHOIS Service is on a yearly basis. The Registrant acknowledges that at anytime the Registrant decides to unsubscribe from the service within the period, transfer the domain to another registrar or terminate the service as a result of reasons listed in clause 1.3 above, there will be no refund for the remaining period.
1.5 The terms and conditions for the SafestWHOIS Service are in addition to the terms and conditions to the Service Agreement related to domain name registration services.
